Terms of Service

1. License Grant

CyberGuardian grants you a non-exclusive, non-transferable license to install and use the CyberGuardian software on the number of Windows endpoints covered by your subscription plan:

• Starter: Up to 25 endpoints
• Professional: Up to 100 endpoints
• Enterprise: As specified in your Enterprise Agreement

2. Acceptable Use

You may use CyberGuardian only for lawful purposes. You must not:

• Use the software to conduct unauthorized access to computer systems
• Reverse engineer, decompile, or disassemble the software
• Resell, sublicense, or redistribute the software without written permission
• Use the honeypot network to entrap legitimate users
• Disable or circumvent security features of the software
• Use the software in violation of any applicable law or regulation

3. Subscription & Payment

• Subscriptions are billed monthly or annually in advance
• All prices are in EUR and exclude applicable VAT
• Payment is processed securely via Stripe
• Subscriptions auto-renew unless cancelled at least 7 days before renewal date
• No refunds for partial months. Enterprise contracts may include custom refund terms.

4. Free Trial

• 14-day free trial requires no credit card
• Trial includes full Professional plan features
• Trial data is deleted 30 days after trial expiration
• One trial per organization

5. Service Level Agreement (SLA)

• Uptime: 99.9% monthly uptime for cloud backend services
• Agent availability: Local agent operates independently — unaffected by cloud outages
• Support response: Starter — 48h email; Professional — 24h priority; Enterprise — 4h dedicated
• Threat feed updates: Every hour, automatically

6. Data & Security

CyberGuardian processes security telemetry from your endpoints. You retain ownership of all your data. We act as a data processor under GDPR. Full details in our Privacy Policy.

7. NIS2 Compliance Features

CyberGuardian provides compliance tooling to assist with NIS2 obligations. However, ultimate compliance responsibility rests with your organization. CyberGuardian is not a legal advisor and does not guarantee regulatory compliance outcomes.

8. Intellectual Property

CyberGuardian and all associated software, documentation, and branding are the exclusive property of CyberGuardian Security EOOD The MITRE ATT&CK framework is owned by The MITRE Corporation and used under fair use for security research purposes.

9. Limitation of Liability

To the maximum extent permitted by applicable law, CyberGuardian shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Termination

Either party may terminate the subscription at any time. Upon termination, your license expires and you must uninstall the software. We will delete your data within 90 days of termination (except where retention is required by law).

11. Governing Law

These Terms are governed by the laws of the Republic of Bulgaria. Disputes shall be resolved in the courts of Sofia, Bulgaria, or through binding arbitration if mutually agreed.
